The following docu- ments will assist the public in understand- ing why an Immigration Convention was called, and will go far to justify the action of that body in calling the attention of Con- gress to the abuses of the system established by the New York authorities: NEW YORK, Sept. 15, 1870. His Excellency Lucius Fairchild, Governor of Wisconsin: SIR: Knowing the great interest you have manifested in behalf of immigration to the United States, and believing that the control of immigration should be vested in the General Government, rather than under State authority, the undersigned beg most respectfully to suggest to your Excellency the propriety of calling a National Conven- tion at which the great States and commu- nities of the West and Northwest should be represented, for the purpose of considering this important question, and the adoption of such measures as will best promote these ends, and thus place the emigrant under the protection of the United States, while in transitu. We have deemed you the proper Execu- tive to take the initial steps in securing from the people of the West an expression of their views, and shall be most happy to aid in carrying them into effect. Grinnell is United States Naval Officer of the port of New York, and for the last quarter of a century has been one of the leading shipping merchants of the country. Hon. Wm. E. Dodge is of the house of Phelps, Dodge & Co., New York, and was formerly a member of Congress. Cyrus Curtiss was Commissioner of Im- migration of the State of New York from 1856 to 1870. He resigned his commission during the past summer by letter, which the present Board of Commissioners of Immi- gration, for reasons best known to them- selves, have not seen fit to publish. John E. Williams is President of the Me- tropolitan Bank of New York City. Den[-]ing Duer[-]s the senior member of the banking house of James G. King's Sons & Co., one of the oldest banking houses in the United States. C. E. Groesbeck is of the banking house of Groesbeck & Co. Hon. Thomas Murphy is United States Collector of the port of New York. The above letter, written and signed by these gentlemen, all of them intimately con- nected with the interests of the city and State of New York, was the result of a full knowledge on their part of the abuses and frauds practiced upon immigrants arriving at that port, and the necessity of an ex- tended jurisdction and care over that peo- ple beyond the limits of the State of New York. Such frauds and abuses as are shown of frequent occurrence, by the large num- ber of affidavits now in possession of the [Column 2] Permanent Committee of the Convention just held, of which the following is a sample: [Copy.] State, City and County of New York, ss: George W. Daley, being duly sworn, doth depose and say that he is a resident of Edgewater, Richmond County, State of New York; that he has, for the past year, been employed as an officer under the United States Superintendent of Emigration; that he knows of his own knowledge that over- charges have been made on emigrants in the Castle Garden Emigrant Depot. From the first day of July, 1865, to the last day of February, 1866, emigrants were charged from Chicago to Beloit, one dollar each; from Chicago to Davenport, two dollars and five cts each; from Chiacgo to Janesville, three dollars and fifty cents each; from Chicago to Rock Island, one dollar and fifty-five cents each, more than second class passengers. He further swears that there were numerous other points, as many as 35, where the same overcharges were made on the emigrants, varying in amount from ten cents to five dollars and fifty cents on each ticket; that in numerous instances emigrants were tick- eted to Davenport, Iowa, and then only fur- nishing tickets to Rock Island, they charg- ing the emigrant fifty cents more than the price to Rock Island on each ticket; that from the first of July aforesaid until the close of Lake Michigan, emigrants were charged in Castle Garden, fifteen dollars and fifty cents each from New York to Milwau- kee, when the tickets could be purchased for twelve dollars each outside the Garden. He further swears that on the 15th day of the present month he purchased a ticket from New York to Milwaukee direct, from the offices of the railroads in this city forming that line, for which he paid the sum of twelve dollars, and that this was all that he was asked or charged for such ticket, and that there was not one cent of commissions or drawback asked for or received by this deponent; that on the morning of the 16th of the present month, he applied for and pur- chased a ticket to Milkwaukee at the emi- grant agency in Castle Garden, for which he paid the sum of fifteen dollars and fifty cents; that he neither asked for nor received any commissions or drawbacks on said ticket; that upon comparing said two tickets, they were each by the same route, as follows: New York to Albany by Hudson River Railroad, from Albany to Suspension Bridge by New York Central Railroad, from Sus- pension Bridge to Detroit by Great Western Railway, from Detroit by Great Haven by Detroit and Milwaukee Railroad, and from Grand Haven to Milwaukee by steamers. He further swears that emigrants were charged five dollars each in Castle Garden during all the year 1865, for tickets from New York to Baltimore, and that the emi- grant fare from New York to Philadelphia was but one dollar and seventy-five cents, and that the second class fare from Philadel- phia to Baltimore was but two dollars and fifteen cents during all that time, or a total of one dollar and ten cents less than the price charged emigrants in Castle Garden. Mr. Casserly, the Notary before whom the above affidavit was sworn, was, and is, the Superintendent of Castle Garden, and was a delegate from New York to this Conven- tion, yet, in the face of such testimony he had the audacity to proclaim that no immi- grant ever passed from Castle Garden the victim of fraud, extortion or abuse. ----- new page (MSS843_B1_F10_p005.jpg) National Immigration Convention, ROOMS OF THE EXECUTIVE COMMITTEE, CHICAGO, ILLINOIS, December, 1870. The "NATIONAL IMMIGRATION CONVENTION," called by the Governors of the North-Western and Western States, met at Indianapolis, Ind., on the 23d day of November last. There were twenty-two States and two Territories fully and ably represented at the Convention. The following Preamble and Resolutions were adopted by the Convention: REPORT OF THE COMMITTEE ON RESOLUTIONS. The committee on resolutions respectfully submit the following report, as sub- stantially embracing the predominant sentiment of the members of the "Immi- gration Convention," as contained in the resolution referred to us for consideration: It must be manifest to all who have heard the deliberations and discussions of the Convention, that justice, patriotism and philanthropy demand the immedi- ate interposition of enlightened public sentiment and law for the protection of the rights and interests of the peoples of other lands, who are annually leaving their native countries and coming to our great national home of freedom. That ----- new page (MSS843_B1_F10_p006.jpg) great and grievous wrongs have been perpetrated, cannot be doubted; and it is equally clear and full and efficient remedies for existing evils ought to be supplied. The important question to be solved is: What source or department of power can afford an adequate remedy? It is believed to be the judgment of this Convention, as indicated by the resolutions introduced and referred to the com- mittee, that upon our National Government is devolved the duty and responsibility of controlling jointly with other governments the embarkation and transit of emigrants, and co-operatively with auxiliary institutions in controlling the debark- ation and protection of the emigrants, in obtaining a permanent home in the place of their choice in the land of their adoption. This is eminently a question of national importance, as upon the proper pro- tection, care and culture of this class of population largely depend not only their progress and prosperity, but also the fullest development of the resources of our country, and the permanency and perpetuity of our Republican principles and institutions. The committee therefore present the following resolutions as con- taining, briefly but substantially, the views of this Convention: 1. Resolved, That additional legislation and a more rigid enforcement of existing laws on the subject of immigration are necessary to prevent actual abuses and frauds and protect the true interests of the emigrant on his arrival and while in transit to his destination in this country, and that for the accomplishment of this purpose, in the opinion of this Convention, appropriate legislation is imperatively demanded of the Federal Government. 2. Resolved, That the President of the United States be respectfully requested to open negotiations with countries from which persons emigrate to this country, so as to secure a joint jurisdiction on emigrant ships for the protection of ----- new page (MSS843_B1_F10_p007.jpg) emigrants against abuse and fraud, and that a copy of this resolution be transmitted to the President of the United States, and to the Congress of the United States. 3. Resolved, That this Convention unqualifiedly condemns all schemes, com- binations and monopolies oppressive to emigrants, by which they are deprived of the proper and usual facilities for cheap and safe transportion, and by which various impositions are practiced upon their indigent and dependent condition. 4. Resolved, That in the opinion of this Convention, a "Bureau of Immi- gration" should be established under the auspices of the Federal Government. 5. Resolved, That a committee of one from each state and territory repre- resented in this Convention, be appointed to memorialize Congress for such legis- lation as will most fully accomplish the views expressed in the foregoing resolutions. 6. FINKELNBURG, on leave, introduced the following bill: A BILL To amend an act entitled "An act to regulate the carriage of pas- sengers in steamships and other vessels," approved March third, eighteen hundred and fifty-five. Whereas various States (seaboard or on the seaboard) have en- acted laws regulating the carrying of alien passengers from foreign countries to the United States, requiring commutation their respective ports of destination; and whereas the vast importance to the country at large of immigration renders it a subject of national concern, and the Constitution of the United States has committed to Congress the exclusive power of regu- lating commerce, of which the carrying of passengers in vessels for hire is a branch: Therefore, 1 Be it enacted by the Senate and House of Representa- 2 tives of the United States of America in Congress assembled, 3 That section twelve of an act entitled "An act to regulate the car- 4 riage of passengers in steamships and other vessels," approved ----- new page (MSS843_B1_F10_p010.jpg) 5 March third, eighteen hundred and fifty-five, be, and the same 6 is hereby, amended so as to read as follows; "The captain, 7 master, or other person in charge of any ship or vessel 8 arriving in the United States or any of the Territories 9 thereof, from any foreign place whatever, at the same time 10 that he delivers a manifest of the cargo, and if there be no 11 cargo then at the time of making report or entry of the ship 12 or vessel pursuant to law, shall also deliver and report to the 13 collector of the district in which such ship or vessel shall 14 arrive, a list or manifest of all the passengers taken on board 15 of the said ship or vessel at any foreign port or place, in 16 which list or manifest it shall be the duty of the said captain, 17 master, or other person in charge of such ship or vessel to 18 designate particularly the age, sex, place of birth, last place 19 of residence, and occupation of the said passengers respect- 20 ively, the part of the vessel occupied by each during the 21 voyage, the country to which they severally belong, and that 22 of which it is their intention to become inhabitants; and to 23 further set forth whether any and what number have died on 24 the voyage; which list or manifest shall be sworn to by the 25 said master in the same manner as directed by law in relation 26 to the manifest of the cargo. And the refusal or neglect of 27 the captain, master, or person aforesaid to comply with the 28 provisions o this section, or any part thereof, or the making 29 of a false oath in regard thereto, shall subject him and the ----- new page (MSS843_B1_F10_p011.jpg) 30 vessel to the same penalties, punishments, disabilities, and for- 31 feitures as are provided for a refusal or neglect to 32 report and deliver a manifest of the cargo aforesaid, or to 33 make false oath in regard thereto." 1 SEC. 2. That section fourteen of the said act is hereby 2 amended so as to read as follows: "In case there shall have 3 occurred on board any ship or vessel, arriving at any port or 4 place within the United States or its Territories, any death 5 or deaths among the passengers, (other than cabin passen- 6 gers,) the master, or captain, or owner, or consignee of such 7 ship or vessel shall, within twenty-four hours after the time 8 within which the report and list or manifest of passengers, 9 mentioned in section twelve of this act, is required to be 10 delivered to the collector of the customs, pay to the said col- 11 lector the sum of ten dollars for each and every passenger 12 above the age of eight years, who shall have died on the voy- 13 age by natural disease, and for each and every other passenger 14 the sum of one dollar and fifty cents; and the said collector shall 15 quarterly, in each year, render an account of and pay over 16 the sums of money thus collected or received to the Treasurer 17 of the United States; and the fund thus collected, together 18 with all other moneys received under this act, shall be kept 19 separate and distinct from all other funds, and be designated 20 and known as the immigration fund, and be expended or dis- 21 bursed as in this act hereafter provided. And if the master, ----- new page (MSS843_B1_F10_p012.jpg) 22 captain, owner, or consignee of any ship or vessel shall make 23 a false report, or refuse or neglect to pay the collector the 24 sum or sums of money required, and within the time pre- 25 scribed by this section, he and they shall severally be sub- 26 ject to a penalty of fifty dollars in addition to the respective 27 sums above mentioned required to be paid for each and every 28 passenger, to be recovered by the United States in any circuit 29 or district court of the United States where such vessel may 30 arrive, or such master, captain, owner, or consignee may 31 reside or be, and when recovered the said money shall be 32 disposed of in the same manner as is hereinbefore directed 33 with respect to the aforesaid sum or sums required to be paid 34 to the collector of customs." 1 SEC. 3. That the amount of the several taxes and penal- 2 ties imposed by the foregoing provisions regulating the car- 3 riage of passengers in merchant vessels shall be in lieu of any 4 similar taxes and penalties imposed by any State, and shall 5 be liens on the vessel or vessels violating these provisions, 6 and any such vessel or vessels shall be libeled therefor in any cir- 7 cuit or district court of the United States where such vessel 8 or vessels shall arrive or be, in the name of and by the 9 collector of the port of arrival of said vessel; and the 10 amount of recovery shall be included in and paid over by him 11 as in the foregoing section mentioned and required in regard 12 to other sums, and to form part of the immigration fund. ----- new page (MSS843_B1_F10_p013.jpg) 13 And no vessel shall be allowed a clearance permit until such 14 taxes shall have been fully paid. 1 SEC. 4. That it shall be the duty of the Secretary of 2 the Treasury of the United States in his discretion to 3 designate, from time to time, some one particular dock, 4 wharf, or other place in the principal immigrant ports 5 of entry in the United States, as the only landing- 6 place for immigrants arriving at such port; and it shall 7 not be lawful for any immigrant passenger from a 8 foreign ports or ports to land, or for the captain, master, 9 owner, or consignee to permit any such immigrant pas- 10 senger to be landed at any other dock, wharf, or place in 11 such port, or to go or be put on board of any boat, vessel, 12 tug, or barge, unless on such as may be licensed as herein- 13 after provided to carry such immigrant passengers and their 14 luggage to such designated landing-place, under a penalty 15 of one hundred dollars for each and every such passenger 16 elsewhere landed or put or suffered to go on board any boat, 17 vessel, tug, or barge except as aforesaid, which penalty 18 may be collected from the captain, master, owner, or con- 19 signee, respectively, of the vessel, and shall be a lien upon 20 the vessel, to be recovered and disposed of as in either of 21 the last sections provided. For the purpose of carrying out 22 the provisions of this act, and of the act hereby amended, 23 the Secretary of the Treasury may hire, lease, or purchase, ----- new page (MSS843_B1_F10_p014.jpg) 24 and take leases or conveyances to the United States of any 25 wharf, dock, or place in any such port, upon cession to the 26 United States of jurisdiction over the same, with the usual 27 qualifications. Until such hiring, leasing, or purchase and ces- 28 sion, the President of the United States shall designate some 29 island, whar, dock, or place, the property of the United States, 30 in any such port as such landing-place. And it shall not be 31 lawful for any immigrant passenger to land or be landed at any 32 other place than at such place so designated by the President 33 as herein provided, or to pass or to permit any such passenger to 34 go on board of any vessel, boat, tug, or barge, except such as 35 may be licensed, as hereinafter provided, to take such passen- 36 gers and their luggage to such last-mentioned place, until the 37 Secretary of the Treasury shall have designated some other 38 pier, wharf, or place as hereinbefore provided. Any violation 39 hereof shall be subject to the same penalty and the same lien 40 as aforesaid, which shall be collectable as hereinbefore pro- 41 vided for the violation of any of the foregoing provisions of 42 this section. And the Secretary of the Treasury may, for or 43 without compensation, issue licenses to transports for carrying 44 immigrants and their luggage from their vessels to such land- 45 ing-place, and he shall from time to time make rules and reg- 46 ulations for the government of each and every landing-place 47 thus designated, and in his discretion may permit thereon, 48 for or without compensation, such facilities and accommo- ----- new page (MSS843_B1_F10_p015.jpg) 49 dation to railroad, steamboats, and transportation com- 50 panies or persons engaged in the business of forwarding 51 immigrants and their luggage as he may think necessary or 52 proper, and he may make rules and regulations for the making 53 of contracts for such transportation and such regulations as he 54 may deem necessary for the care of the sick and indigent, and 55 for the comfort, safety, and protection of the immigrants, their 56 landing, imparting to them information, obtaining employment 57 for them, and forwarding them to any part of the United 58 States upon the most advantageous terms, in a safe, comfortable, 59 and speedy manner, and without unnecessary delays while in 60 transit. 1 SEC. 5. That there shall be appointed, at such ports of entry 2 as may from time to time be selected for that purpose by the 3 Secretary of the Treasury, a superintendent of immigration, 4 with such clerks and assistants as may be necessary, in the 5 opinion of such Secretary, for the purpose of facilitating and 6 superintending immigration and carrying out the provisions 7 of this act. Such superintendent of immigration shall be 8 appointed and removable by the Secretary of the Treasury, 9 and all clerks and assistants shall be appointed and removable 10 by the superintendent, with the approbation of the Secretary 11 of the Treasury. The salaries of such superintendent and 12 such clerks or assistants shall, from time to time, be fixed by ----- new page (MSS843_B1_F10_p016.jpg) 13 the Secretary of the Treasury, to be paid out of the immi- 14 gration fund hereinbefore provided for. 1 SEC. 6. That it shall not be lawful for any railroad or 2 transportation company, or land or emigrant company, or their 3 officers or agents or other persons, to sell, or to authorize to be 4 sold, tickets for the conveyance of immigrants over unneces- 5 sarily circuitous routes, nor to make or authorize to be made 6 any contracts for such purpose either in the United States 7 or elsewhere, nor to require nor receive payment from immi- 8 grants for extra baggage other than such as would be actually 9 required and demanded from and paid by other passengers 10 for a similar amount and quantity of luggage. And any vio- 11 lation of the provisions of this section shall be an offense pun- 12 ishable by a fine of not less than one hundred nor more than 13 one thousand dollars, and the company, officer, agent, or other 14 person so offending, or otherwise imposing upon, defrauding, 15 or ill-treating immigrants, or being in any manner a party 16 thereto, shall not thereafter be permitted to have access to 17 immigrants at any landing-place established under this act; 18 and any failure or neglect of superintendents of immigration 19 to enforce the provisions of this section, or any failure or 20 neglect to perform any other duty required of them for the 21 protection of immigrants under this act, shall be cause for 22 peremptory dismissal from office. 1 SEC. 7. That railroad companies carrying immigrant ----- new page (MSS843_B1_F10_p017.jpg) 2 passengers shall provide comfortable cars for such passengers, 3 which shall not be overcrowded, and which cars shall be 4 properly ventilated, provided with necessary closets, warmed 5 in cold weather, and supplied with fresh and cool drinking 6 water at all times. And emigrant trains shall not be delayed 7 to make way for freight or cattle trains; and any railroad 8 company violating the provisions of this section shall for 6 every such offense be liable to a fine of not less than one 10 hundred nor more than one thousand dollars, to be recovered 11 to the use of the United States for the immigration fund, 12 upon complaint of any officer of immigration, passenger, or 13 other person. And it shall be a part of the conditions upon 14 which railroad companies may have access to immigrants at the 15 landing-places herein provided for, that the condition of this 16 section shall be complied with. 1 SEC. 8. That all expenses incurred in carrying out the 2 provisions of this act, including rents, purchase-money of 3 docks, wharves, or other places, shall first be paid out of the 4 immigration fund in such manner and on such vouchers and 5 proofs as may be required by the head of the Treasury Depart- 6 ment, and the balance of such fund, or so much thereof as 7 may be required, may be applied as the said Secretary may 8 direct in aiding and assisting immigrants to remove from the 9 port of their arrival, or in obtaining employment, or otherwise, 10 for the benefit of such immigrants. That it shall not be lawful for any person other 2 than the officers of the customs officers and employees under 3 this act, and those specially licensed or authorized thereby, 4 and the health officer and his deputies being physicians at the 5 port of arrival, to go on board of or have any communica- 6 tion with any ship or vessel having immigrants on board, or 7 with the passengers thereof, until after they shall have been 8 landed therefrom, and no officer of the United States at the 9 port of arrival, and no clerk, employee, or other person 10 appointed under this act, shall be directly or indirectly inter- 11 ested in any corporation or company having lands for sale 12 to immigrants, nor shall any such officer, clerk, employee, or 13 other person appointed under this act be interested as agent or 14 employee of any railroad, steamboat, or transportation company 15 or person engaged in transportation of immigrants, or in keeping 16 boarding-houses or houses of entertainment for immigrants, 17 or engaged at such port in any business connected 18 with the forwarding of immigrants or their luggage. Any 19 person violating the provisions of this section, or who 20 shall receive any fee or reward from an immigrant for ser- 21 vices rendered in the line of his duty, shall be guilty 22 of a misdemeanor, punishable by a fine of not less 23 than one nor more than five hundred dollars, and also, 24 in the discretion of the court, with imprisonment not 25 exceeding one year. That any of the duties prescribed for collectors 2 of customs by the act to which this is amendatory may, in 3 the discretion of the Secretary of the Treasury, be devolved 4 upon and performed by the superintendent of immigration, 5 and at any port of the United States where no superintendent 6 of immigration has been appointed, the duties of such 7 superintendent shall devolve upon, and be performed by, the 8 collector of customs at such port. 1 SEC. 11. BISHOP HUNTER, DEAR BROTHER: In consideration of the great number who anticipate immigrating to this Territory from Europe and the United States during the ensuing season, it is deemed necessary to send 500 teams to the terminus of the U.P.R.R., each team to consist of one wagon and four yoke of oxen, or their equivalent in strength in either mules or horses. They should start from this city about the 15th of June, It is well known that the Union Pacific Railroad is now prepared to convey passengers and freight upwards of five hundred miles west of Omaha, on the Missouri River. With these great facilities for transportation, there are some inconveniences which must be provided for; viz; A depot should be formed at a spot deemed most suitable near the terminus of the Railroad, where provisions may be stored, and which will afford good camping facilities for our immigrants. We do not anticipate purchasing provisions and other supplies for the people in the Eastern market, but purpose sending means of subsistence with the teams which will meet them at the terminus of the U.P.R.R., hence it will be necessary for the inhabitants of the Territory to make donations of the bounties with which they have been so liberally provided. We hope not less than 5,000 Adults will cross the Plains this season, en route for this Territory. To feed this vast number of people will require large quantities of Flour and Beef, which may be apportioned among the trains, and be easily driven to the outfitting point. We would recommend that Dried Fruit, Bacon, Cheese, Vinegar, Beans, Pickles, Peas and Dried Corn be gathered up and sent with our teams, which articles will prove very beneficial to the people, and no doubt cause a decided improvement in their health and comfort. The people of this Territory have an abundance of these articles, and if their attention be called to the fact that they will prove conducive to the health of the immigrant, they will take pleasure in supplying the wants of their brethren who are journeying hitherward. Immediate steps should be taken to provide the above supplies and we shall expect you and your counsel to superintend these matters in accordance with former instructions on similar occasions. To the Secretary of the Perpetual Emigrating Company Sir, Having been officially informed by His Excellency Brigham President of "The Perpet- -ual Emigrating Company, that at their last meeting, the undersigned was elected by their vote a member and Treas- urer of said company, which was cheerfully accepted, and you being the proper officier to whom returns should be made, I herewith forward you my bonds as such, for the approval of the President, in compliance with the Law contained in the "ordinance incorporating that Body." In addition to the notes in my hands for collection due the Company by sundry Persons who were assisted by the Fund, the Book indebtedness, or open accounts, exclusive of notes, amounts to $11,664 33/100, which amount added to the present credit of Stock Account of $25,971 23/100 would increase the aggregate or Grand total to the amount of $37,455 36/100; this latter amount, excepting losses by bad debts is the nett Capital Stock of the Company so far as my knowledge of its affairs extend. There is nearly $300 worth of property verbally promised by Sundry Persons, which as yet has not come into my possession, but I have no doubt will be paid as soon as the parties concerned will find it convenient for them to do so. Of late, Wheat, Vegetables, Clothing, some Cash &c are more readily & freely donated from the various settlements than for sometime previous, but those indebted to the Company for assistance, have been, and are, rather slow in coming forward to liquidate their various amounts justly due.
